Community Standards

Nothing in this Agreement limits liability for: death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that applicable law prohibits limiting.

Protecting Bernick Blay
You agree to defend and indemnify Bernick Blay against claims arising from your actions in Scratch That Clover.
You agree to indemnify and hold harmless Bernick Blay and its affiliates, officers, directors, employees, and agents from and against all claims, liabilities, and costs — including reasonable attorney's fees — from: (a) your Terms violations; (b) your Scratch That Clover use; (c) your content; (d) your law violations.
Defense: Bernick Blay reserves the right to assume control of the defense of any matter subject to your indemnification. You agree to cooperate with our defense of such claims.

Handling Legal Disputes
We hope you never have a dispute with us, but if you do, here's our fair and efficient process for resolving it.
Most disputes can be resolved with a simple conversation. Please email our support team first. If we can't resolve your issue within 30 days, you may proceed to formal dispute resolution.
Arbitration (Where Permitted): Disputes not resolved informally will be submitted to binding arbitration on an individual basis. Class-action arbitration is not permitted.
No Class Actions
You agree to resolve disputes with Bernick Blay on an individual basis only. You waive any right to participate in class action or group proceedings.
Exceptions: Either party may seek emergency injunctive relief from a court of competent jurisdiction. Individual small claims actions are also exempt from this arbitration agreement.

Account Closure
Either party can end this agreement. Here's how termination works for both you and Bernick Blay.
You have the right to stop using Scratch That Clover and close your account at any time without penalty. Email our support team to request account deletion.
We reserve the right to suspend or permanently terminate your account for: Terms violations, fraud, abuse, or conduct that harms the Scratch That Clover community. We'll provide notice when circumstances allow.
After Termination:
- Your license to use Scratch That Clover ends immediately
- App-specific access or saved settings in a terminated account may become unavailable
- Sections of these Terms that should survive (like IP rights, indemnification, and dispute resolution) remain in effect
We may discontinue Scratch That Clover with reasonable prior notice. Refund eligibility in such cases will be evaluated under applicable law.

Legal Governing Provisions
